Terms of Service

DRAFT — this document is pending attorney review and is provided as a good-faith summary of how MoldDesk operates. It is not yet a final legal agreement.

Effective date: September 24, 2026

1. The service

MoldDesk is software for mold inspection businesses: inspection and clearance report authoring, photos and lab documents, PDF generation, scheduling, team management, client report sharing, and invoicing. MoldDesk is operated by [ENTITY] (“we”, “us”). By creating an account or using MoldDesk you agree to these terms on behalf of yourself and, if you act for one, your company.

2. Accounts and roles

You are responsible for your credentials and for activity under your account. Company admins control team membership, roles, billing, and company data; inspectors access the reports they create or are assigned per the company’s settings.

3. Subscriptions, trials, billing

  • Prices for each seat type are the ones listed on our pricing page at the time you subscribe or change seats.
  • New companies get a 10-day free trial; no card is required to start it.
  • Paid plans renew automatically each month until you cancel. We may change our fees with at least 30 days’ notice by email; a changed fee takes effect at your next renewal after that notice.
  • Fees are non-refundable. You can cancel at any time; your access continues through the end of the period you have paid for, and we do not prorate or refund the unused part of it.
  • Past-due accounts may lose write access and, after a grace window, be cancelled.
  • Taxes are your responsibility where applicable.

4. Client payments (Stripe Connect)

Companies may connect a Stripe account to collect payments from their clients. Those payments flow through the company’s own Stripe account in full — MoldDesk adds no platform fee and is not a party to the transaction between an inspection company and its client. Stripe’s terms govern the connected account; disputes and refunds are handled by the company in Stripe.

5. Your data

Your company owns the report data it enters (client details, property information, observations, photos, documents). You grant us the rights needed to host, process, back up, and display that data to operate the service — nothing more. Handling of personal information is described in our Privacy Policy. You are responsible for having the right to enter the data you enter, and for the accuracy of the reports your company issues.

6. Acceptable use and restrictions

  • No unlawful use, no infringing or malicious content.
  • No probing, disrupting, or circumventing security or tenant isolation.
  • No use of the service to send spam.
  • No reselling access to the service, and no white-labeling it, without an agreement with us.
  • No using the service to build a competing product, and no reverse-engineering, decompiling, or copying it.
  • No load-testing or stress-testing the service.

7. Not an inspector

MoldDesk is a documentation tool. We do not perform, supervise, direct, or warrant any inspection, and we do not interpret lab results or provide licensed professional judgment. The inspector and their company are solely responsible for the inspection itself; for every finding, observation, measurement, and recommendation in the report; for compliance with any state-specific mold reporting requirements; and for their agreements with their own clients. MoldDesk is not a party to those agreements.

8. AI-assisted drafting

Voice transcription and “Polish with AI” are drafting aids: they transcribe, format, and improve the clarity of text the inspector provides. They are designed not to add findings, conclusions, or professional judgments, and must not be relied on to do so. You are responsible for reviewing and approving all AI-assisted text before finalizing a report.

9. Feedback

If you send us suggestions or feedback about the service, we may use them freely — including to build features — with no obligation to you.

10. Availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may change or discontinue features with reasonable notice for material changes.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS CAPPED AT THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, AND WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. THESE LIMITS APPLY TO EVERY KIND OF CLAIM.

13. Indemnification

You will defend and indemnify MoldDesk, and hold us harmless, against any claim, loss, or expense (including reasonable legal fees) arising from your use of the service, the content you or your company enter, or the reports your company issues — including any claim by your client about an inspection or a report.

14. Termination

You may cancel at any time. We may suspend or terminate accounts that materially breach these terms, with notice where practicable. For 30 days after cancellation an admin on your account can download your company’s data — contacts, reports, and invoices as CSV files — from Settings → Data; after that, it is deleted as described in our Privacy Policy.

15. Governing law and venue

These terms are governed by the laws of the State of California, excluding its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Alameda County, California, and you consent to their jurisdiction.

16. Changes to these terms

We may update these terms. We will post the new version here and email account owners at least 30 days before it takes effect. Continued use after that date is acceptance of the updated terms.
